Risk Warning: Virtual currency is volatile, not legal tender, and not insured by any government deposit insurance program. Transactions are generally irreversible once sent. Only use funds you can afford to lose.

1. Who We Are

DefiExchange is operated by DEFI SOLUTIONS INC. ("we", "us", "our"), registered with FINTRAC as a Money Services Business (MSB C10001285), located at 205 Placer Ct, Unit 301, North York, ON M2H 0A9.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts.
You must complete identity verification (KYC) before placing any order, as required by Canadian anti-money-laundering law.
You may not use DefiExchange if you are located in, or a resident of, a jurisdiction where use of our service would be unlawful.

3. The Service

DefiExchange facilitates the exchange of Canadian dollars (CAD), sent via Interac e-Transfer, for virtual currency sent to a wallet address you provide. We do not custody your virtual currency on an ongoing basis — once sent, it is transferred directly to the wallet address you specify and is no longer in our control.

4. Fees and Rates

Applicable fees and exchange rates are disclosed to you before you confirm an order. Rates may fluctuate and are set at our discretion based on market conditions.

5. Your Responsibilities

Provide accurate identity, contact, and wallet information.
Double-check your wallet address and network before submitting an order — sending to an incorrect address, or selecting the wrong network, generally cannot be reversed and we are not responsible for resulting losses.
Not use DefiExchange for any illegal purpose, including money laundering, terrorist financing, or fraud.
Keep your login credentials confidential.

6. Compliance and Reporting

As a registered MSB, we are required by law to verify your identity, maintain transaction records for at least five years, and report certain transactions and suspicious activity to FINTRAC. We may decline, delay, or reverse a transaction, or suspend or terminate your account, where necessary to comply with legal or regulatory obligations.

7. Risks

Virtual currency values are highly volatile and can decline significantly, including to zero.
Virtual currency is not legal tender and is not backed or insured by any government or deposit insurance program (including CDIC).
Blockchain transactions are generally irreversible.
Technical issues, network congestion, or errors in wallet address entry can result in delayed or lost funds.

8. Limitation of Liability

To the maximum extent permitted by law, DefiExchange and DEFI SOLUTIONS INC. are not liable for indirect, incidental, or consequential damages arising from your use of the service, including losses due to market volatility, third-party wallet or network issues, or user error in providing wallet details.

9. Termination

We may suspend or terminate your account at our discretion, including where required for legal or compliance reasons, or where we suspect fraudulent or illegal activity.

10. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
